Posted on: Monday November 17, 2008Every week 35 tradesmen including electricians, plumbers and joiners die from asbestos related disease. Many don’t realise they can claim. Usually there is a delay between exposure and disease of between 20 and 40 years.
Despite this delay claims can and should be pursued.
“Many workmen don’t realise that although it can be as long as 40 years since they were exposed to asbestos dust, they can make a claim against the company or companies that employed them at that the time of exposure – even if that company is no longer trading,” said Nicola Winslett, Personal Injury Partner at SAS Daniels LLP.
“In some instances, we’re able to help trace the insurance company their employer used at the time – there are options open – even though many years have elapsed.”
There are three diseases related to asbestos exposure; Mesothelioma, Lung cancer and Asbestosis – and the death rates from all have continued to rise year on year. The Health and Safety Executive estimate that 25,000 deaths have occurred due to Mesothelioma to date and a further 25,000 will occur by 2035.
“Asbestos exposure, to even one particle, can cause Mesothelioma. The number of cases being diagnosed is increasing year on year,” said Nicola.
“I can’t stress strongly enough, that the period of time elapsed between exposure and diagnosis should not be a barrier to personal injury claims and neither is not knowing which of many employers may have caused the exposure.”
