Children Issues
Private law proceedings relate to disputes between parents in relation to their children. The Courts will not make Orders where the parents are able to agree amicably how the children will be cared for in the future.
Where there is a dispute, the Court can be asked to make the following orders:
• Residence Order – determines with whom the child should live
• Contact Order – determines the times and dates that a child should see the parent with whom he/she does not live
• Prohibited Steps Order – prevents a parent from, in particular, taking a decision to remove the children from the jurisdiction or other unilateral decision without the consent of the other parent
• Specific Issue Order –gives a direction to determine an issue arising concerning the child, for example, which school the child should attend, and which religion the child should follow
